General Conditions of Sale and Use of the Website

The information and provisions published on this website determine the conditions of sale and purchase of products sold on the website www.freser.si by Matjaž Frešer, Ritoznoj 17, 2310 Slovenska Bistrica, Slovenia.

Please read the general conditions carefully before purchase or registration in the e-shop. By using this website, you are agreeing to the general conditions and confirming that you have read and understood them. Matjaž Frešer reserves the right to change the conditions of this website.

Information

The website owner commits to always providing the buyer with the following information:

  • Company identity,
  • Contact information,
  • Product description,
  • Product availability (each product on offer is available within a reasonable timeframe),
  • Conditions of product delivery or execution of service (type, location and time of delivery),
  • Prices,
  • Form of payment and delivery,
  • Temporal validity of the offer,
  • Deadline and conditions of withdrawal from purchase (the expenses of returning a product for the buyer),
  • Explanation of a complaint procedure, including all information about a contact person or customer contact service.

Prices

All the prices in this e-shop are cited in EUR and include VAT.

The prices are valid at the time of product order and do not have a predetermined expiration time. Once the provider confirms the order, all prices and other terms are set and binding for both the provider and the buyer.

The website owner is always committed to providing correct and current information on this website, but mistakes in deliverability, product descriptions and prices may occur inadvertently. In such cases, the company will inform the buyer about the changes and give them the opportunity to withdraw from the purchase, or find a solution that satisfies both sides.

Forms of Payment

On this website, the company accepts the following forms of payment:

  • Payment upon delivery – after purchase confirmation the company dispatches the product within five workdays, with the buyer paying for the ordered products upon delivery.
  • Payment by invoice - after purchase confirmation the buyer receives an order summary and an invoice. The company dispatches the products after the invoice has been paid.
  • Payment with a credit card or PayPal.


Order and Delivery

The sale/purchase contract between this e-shop and the buyer is concluded when the buyer submits their order in the e-shop and receives the first email regarding the status of their order. The order is in queue and all prices and terms are set and binding for both the e-shop and the buyer. If the buyer does not receive an email after submitting an order a technical problem or incorrect information might be at fault. You can repeat the process or contact us for help.

The buyer is the person whose data is listed and recorded in the e-shop system upon submitting the order.

The company dispatches the ordered products within the agreed-upon timeframe. In case of unexpected delays in delivery, the buyer will be informed by phone or email.

In case the buyer often fails to collect the delivered package, we reserve the right to have the customer pay for the product ahead of delivery (by invoice).

Placing Orders

1. Adding products to the shopping basket
When a buyer finds the right product in the e-shop, they add it to the shopping basket by clicking on the “add to basket” button. Products are organised by category, so they can also be searched for using the search bar. For more information about a product click on the image. You can add any number of products to the basket. Once you are done adding products to the basket you can either continue shopping later or finalize your purchase. After selecting the products and reviewing the contents of the shopping basket, the buyer continues to check-out. The quantity of each product can be additionally adjusted in the basket.

2. Purchase
To conclude the purchase the buyer must enter correct contact information and decide on a form of delivery and payment. An unregistered buyer must fill out a registration form in order to register before the first purchase.

3. Finalizing the purchase
Before you finalize the purchase, double-check that the list of ordered products is correct. An order summary will be sent to your email address.

Delivery

Ordered products will be dispatched to your address within five working days.

Delivery is free for orders of 50,00 EUR and above. For orders below 50,00 EUR the cost of delivery is 10,00 EUR.
VAT is included in delivery costs.

The contract partner, with whom we cooperate in delivering the packages, is the Post of Slovenia. In order to guarantee the most efficient way of fulfilling your orders we reserve the right to choose a different delivery service.

No delivery costs are charged if the buyer picks up purchased products personally from the seat of the company (Ritoznoj 17, 2310 Slovenska Bistrica, Slovenija). In this case, you will be informed when the order is ready and can pick it up by prior arrangement.

These terms and delivery costs are only valid within the territory of the Republic of Slovenia.

Withdrawal from Purchase

The buyer has the right to withdraw from the transaction without having to cite a reason within 14 days of receiving the order. The 14-day period begins on the day after the buyer received the products.

If the product is faulty or does not correspond to the product description on the website, the buyers may exercise their rights resulting from a material defect.

A notice of withdrawal must be submitted in writing with the purchase receipt to the email address vino@freser.si.

In the case of withdrawal, the buyer must return the purchased goods in person or by mail to the following address: Matjaž Frešer, Ritoznoj 17, 2310 Slovenska Bistrica, Slovenia. The returned items must be undamaged and of undiminished quantity, unless the product is damaged, broken, lost or has diminished in quantity through no fault of the buyer. The buyer is not allowed to use the product before withdrawing from purchase. The buyer may inspect and test the products to the extent that it is necessary to ascertain their condition. The buyer is responsible for the diminished value of the product if it is the consequence of actions which are not strictly necessary for establishing the nature and quality of the product.

After withdrawing from the purchase the buyer will be reimbursed for the payment or receive new products of the same value. By withdrawing from the purchase, the buyer bears the cost of returning the items (which in case of mailing are priced according to the price list of the delivery service depending on whether it is treated as post/package/cargo). The products must be returned to the website owner within 14 days of sending a notice of withdrawal. Packages with cash on delivery will not be accepted.

The buyer does not have the right to withdraw from the purchase of a product that has been made to the specific requirements of the buyer, was adjusted to their individual needs, is not suitable for return, is highly perishable or already past its use-by date.

Complaints and Disputes

In the case of disagreement with a service rendered or other irregularities, you can lodge a written complaint. The retailer complies with consumer protection law. Users can send their complaints by email to vino@freser.si.

The processing of the complaint is confidential. The website owner must confirm the receipt of the complaint within five days, inform the user about the timeline of processing it and keep them informed of the procedure.

The website owner is aware that a core characteristic of disputes is the disproportion between the economic value of the claim and the cost, both in time and money, of resolving a dispute, which is also the main factor keeping buyers from taking disputes to court. The owner strives to resolve all disputes consensually; otherwise the court jurisdiction is determined by the seat of the company.

Disclaimer

The website strives to the best of its ability to maintain the currency and accuracy of the data published on its online store. However, the product characteristics, stocks and prices may change so quickly that the retailer is unable to update the data published on the online store on time. In such an event the retailer will notify the user about such changes and allow them to cancel the order or exchange the ordered items. We are not liable for any typing errors.

We reserve the right to changes and errors in prices and written content.
